Mediation and Alternative Dispute Resolution

Simon Leach and Amanda Brown are our two Mediators. We also have available to us on a part time basis the services of two other Mediators. Simon and Amanda are also trained Collaborative Lawyers. We are able to therefore offer Mediation to our private clients to include Mediation information and Assessment Meetings (MIAMS)

Mediation is the process by which clients make decisions for themselves regarding children and financial issues arising from their relationship breakdown. The Mediator's role is to assist the parties in reaching agreement and is likely to involve a number of round the table meetings.

Mediation is not suitable to all clients but has a particularly high success rate in those cases where clients are able and willing to try and resolve problems in a constructive and cooperative manner, and put their children's interests first.

If either you or your former partner are intent on 'winning' this process will certainly not be suitable to you.

The advantages of Mediation are that it is quicker, cheaper and more long-lasting than the Court process. The clients also retain control of the decision making, rather than leaving it to the hands of third parties such as Judges and Cafcass Officers. What we stress to clients is that whether they try Mediation or the Court process, the result will quite often be the same, it is just a question of how much time, emotional energy and money that tends to distinguish the two processes.
